Employers are required by law to confirm the identity of all new employees and verify that they are either American citizens or aliens legally authorized to work in this country.

Churches that are opposed on the basis of religious convictions to complying with the Form I-9 requirement are exempted from doing so.

Employers must check original documents establishing every new employee’s identity and eligibility to work, and then certify on Form I-9 that they in fact inspected the original documents verifying the employee’s identity and eligibility to work.

Churches must file a copy of every Form I-9 with the Immigration and Naturalization Service within 90 days after hiring an employee.

A small church hires a new custodian at a rate of $100 per month. The custodian chooses her own hours, provides her own supplies, and works without any supervision. The Form I-9 requirement does not apply in this case.

United States citizens are not required to prove their eligibility to work by completing Form I-9. The form only applies to immigrants.

A church must complete an I-9 for everyone who applies for a job.

If an employee is unable to provide the required documents within three days, he or she must at least produce a receipt showing that he or she has applied for the documents. The employee must then produce the documents within 21 days.
